CBP ruled that the Caper Cart, a "'smart' shopping cart" imported by Instacart, is classified as a vehicle under Harmonized Tariff Schedule heading 8716. The agency said in a customs ruling released Jan. 12 that the cart is "essentially" a manually propelled vehicle that transports goods and functions as a cart, regardless of whether the electronic payment features and point-of-sale system are on the cart.

CBP is adding a new functionality in ACE that will allow importers to identify entries that are the subject of an antidumping and/or countervailing duty certification and show that, for example, the goods aren't subject to AD/CVD orders, the Commerce Department said in a notice released Feb. 1. The new mechanism will be deployed on May 2 and will make AD/CVD entry summaries more "readily identifiable" to Commerce and CBP, the department said.

Members of the National Retail Federation are seeing a rise in freight rates and ocean carrier transportation costs and want to make sure that those new fees and surcharges "actually cover real costs and are not intended for profit," Jonathan Gold, NRF vice president of supply chain and customs policy, told Congress this week.

The Federal Maritime Commission on Jan. 29 approved a request from Taiwanese carrier Wan Hai Lines to immediately impose a westbound Red Sea Surcharge for certain cargo that must be diverted away from the region due to attacks by Houth rebels. Carriers typically need to wait 30 days before imposing a new surcharge, but Wan Hai asked the FMC for an exception to help recover the costs of having to take a longer path around Southern Africa's Cape of Good Hope.
