The Court of International Trade on Oct. 7 denied importer Interglobal Forest's application for attorney's fees in its suit challenging CBP's affirmative finding of evasion of the antidumping and countervailing duty orders on hardwood plywood from China. Judge Mark Barnett said that Interglobal wasn't a "prevailing party" in the action because the evasion determination was reversed without admitting to an agency error and only after the Commerce Department reversed its scope finding after separate legal action at the trade court.
CBP has issued a formal determination that affirms that 12 importers evaded antidumping and countervailing duties for transshipping Chinese-origin mattresses through South Korea. The importers also had claimed that the country of origin for the mattresses was South Korea.

The Regulations and Rulings division of CBP’s Office of Trade has affirmed a Feb. 5 notice of determination under the Enforce and Protect Act (EAPA) that Lollicup USA evaded antidumping and countervailing duty orders covering lightweight thermal paper from China (see 2402090019),
CBP has a "reasonable suspicion" that Fort Lauderdale-based JBS Trading is evading antidumping duties on xanthan gum from China ( A-570-985), it said as it annnounced that the company is under an Enforce and Protect Act investigation. The agency alleges that when JBS Trading imported China-origin xanthan gum into the U.S., it undervalued them at the time of entry, thereby failing to pay adequate cash deposits associated with the AD order, according to a Sept. 13 release.
The Commercial Customs Operations Advisory Committee (COAC) for CBP will next meet Sept. 18 remotely and in person in Washington, D.C., starting at 1 p.m. EDT, CBP said in a notice. Comments are due by Sept. 13.
