The deputy U.S. trade representative whose portfolio covers Asia and Africa acknowledged that it may be more challenging to get buy-in from countries for the Indo-Pacific Economic Framework without the carrot of lower U.S. tariffs, but she said corporate support will help negotiators get agreement.
Amendments that would have directed the Office of the U.S. Trade Representative to broaden access to Section 301 exclusions and would have liberalized the Generalized System of Preferences benefits program will not get a vote when the America Competes Act gets a vote on the House floor this week, but the Ocean Shipping Reform Act will get a vote. That bill passed the House last year, but has not gotten a vote in the Senate.
Although it's not clear whether a full conference committee will be convened, or there will be an informal conference to reconcile the House and Senate packages, some Republicans are leaving the door open to incorporating the antidumping duty and countervailing duty law changes that only appear in the House's America Competes Act. Leading voices on trade in both the House and Senate, however, said the Senate version of renewing the Generalized System of Preferences benefits program and the Miscellaneous Tariff Bill should take precedence over those put forward in the Competes Act, since the Senate trade title had strong bipartisan support.
Although concluding negotiations on subsidies that contribute to overfishing may seem like a long shot, since 21 years has not been long enough to reach agreement, World Trade Organization Deputy Director-General Angela Ellard said there is an eagerness among many member country delegations to get it done. She acknowledged that developing countries' desire to claim "special and differential treatment" under the body's rules to curb overfishing does cause dissension. But, she said, "it's important to show we can do this."
Sandler Travis managing principal Nicole Bivens Collinson said that Sandler Travis is working with companies to develop comments to the federal government on how to implement the Uyghur Forced Labor Prevention Act (see 2201210031) because a lot of companies don't want their names on their comments. "We are creating an ad hoc coalition because I know a lot of companies don't want to go on record," partly "because they may be a global operation that has operations in China," she said, while speaking on a recent webinar hosted by the firm. China prohibits companies from adhering to foreign laws that negatively impact the country.
Thirteen groups that represent business interests told House leaders that they strongly oppose the changes to de minimis in the trade title of the America Competes Act, the House answer to the Senate China bill that passed last year.
The AFL-CIO said the House version of the China package "includes critically important fixes" to the Senate's trade title, including removing finished products from the Miscellaneous Tariff Bill, changes to antidumping and countervailing duty law, and the change to de minimis, which "would halt China’s exploitation of US de minimis policy."
While the U.S. is either the second or No. 1 trading partner for the European Union, Canada and Japan, their ambassadors warned that some of the actions the U.S. has taken in the last five years undermine its alliances. They spoke at the end of the first day of the Washington International Trade Association annual conference.
Rep. Adrian Smith of Nebraska, the new ranking Republican on the House Ways and Means Trade Subcommittee, testified to the Rules Committee that the trade section of the America Competes Act of 2022 contains items that could have a "significant negative impact on our economy," and that Republicans didn't see anything about it until last week. He noted that his amendment that would have renewed trade promotion authority, which gives Congress a say in new free trade negotiations, was ruled out of order, so it will not get a vote.
Two bills that aim to fight the sale of counterfeit goods through e-commerce have been included in the House China package, something House Speaker Nancy Pelosi had called for last year (see 2112150050). While neither was included in the Senate China package, the inclusion of the Integrity, Notification, and Fairness in Online Retail Marketplaces for Consumers Act, known as the Inform Consumers Act, and the Stopping Harmful Offers on Platforms by Screening Against Fakes in E-commerce Act, or Shop Safe Act, in the America Competes Act gives them a reasonable chance of becoming law through the bicameral compromise.
