CBP is unable to refund the alchohol excise tax it collected from a company that mistakenly listed a tax rate over the actual required amount, the agency told Southern Wine and Spirits of America in July 3 ruling. The ruling, HQ H214255, addressed whether CBP has the authority to refund the excess payment that was a result of a miscalculated tax rate listed by Southern Wine on its entry filing. In this case, listing the wrong tax rate was a clerical error, rather than a "mathematical error," leaving CBP unable to give the refund, it said in the further review of protest.

The Food and Drug Administration issued its weekly Enforcement Report for Sept. 17 that lists the status of recalls and field corrections for food, drugs, biologics, and devices. The report covers both domestic and foreign firms.
The Department of Agriculture's Commodity Credit Corporation announced Special Import Quota #6 for upland cotton that will be established on Sept. 25, allowing importation of 14,741,821 kilograms (67,709 bales) of upland cotton. It will apply to upland cotton purchased not later than Dec. 23, and entered into the U.S. by March 23, 2015. The quota is equivalent to one week's consumption of cotton by domestic mills at the seasonally-adjusted average rate for the period March through May, the most recent three months for which data are available.
The Food Safety and inspection Service (FSIS) changed regulations to make way for the Public Heath and Information System (PHIS) Import Component, it said in a final rule notice. PHIS was launched in 2012 and allows for electronic filing for import inspection applications and imported product foreign inspection and foreign establishment certificate processes. The effective date is Nov. 18 and the compliance date is March 18, the notice said..
CBP is requesting comments by Nov. 21 for an existing information collection related to drawback process regulations. CBP proposes to extend the expiration date of this information collection with no change to the burden hours.
The Food and Drug Administration is proposing to revise its previous proposed rules for several Food Safety Modernization Act regulations. The revised proposed rules involve the foreign supplier verification programs (FSVP), manufacturing practices for human and animal foods and produce safety. Comments on the proposed revisions are due within 75 days of publication in the Federal Register, scheduled for Sept. 29. "FDA is proposing new ways to make the original proposals more flexible, practical and targeted," it said.
