Carrier Didn’t Properly Fumigate Imported Bamboo, Complaint Says

EcoBamboo, an Oklahoma-based importer of bamboo products used in privacy fencing and construction, has accused non-vessel-operating common carrier Ship4wd of violating the Shipping Act by failing to properly handle a shipment from Indonesia to the U.S., according to a complaint filed with the Federal Maritime Commission on Sept. 2.

EcoBamboo alleged that Ship4wd didn’t follow fumigation protocol, causing the shipment to be infected with live insects and prompting CBP to deny the shipment entry into the U.S. As a result, EcoBamboo “incurred substantial, well-documented losses,” including lost sales, the complaint said.

EcoBamboo said it should receive $230,865.51 in reparations if it doesn't recover from the shipment failure and $146,015.51 if it does.

In a statement, Ship4wd said, "We are aware of the complaint and are preparing our response, which will be submitted to the FMC as required."
