NCBFAA Compiling Individual Port Positions on ISF Enforcement

The National Customs Brokers & Forwarders Association of America is in the process of surveying CBP officials at individual ports on how they plan to enforce importer security filing (ISF) requirements, the NCBFAA said. CBP headquarters recently revised its strategy for ISF enforcement by giving the ports more discretion as to how to handle ISF violations (see 14052106). CBP has said it hopes the new strategy will allow for more focus on the most serious offenders.

The change in enforcement has "created a very broad range of applied interpretations as to what constitutes a 'late' filing," said NCBFAA. The NCBFAA, working with the Affiliated President's Network made up of the presidents of the regional brokers associations, are asking the port officials "how they define late filing in their ports," said the trade group. The NCBFAA will publish the compiled information in coming weeks so that "the brokerage community can then use this information to improve their compliance rates as well as mitigate their client's exposure to liquidated damages for late ISF filings," it said.
