July 31 CBP Bulletin Proposes to Modify Rulings on Marine Propulsion Bushings

In the July 31 issue of the Customs Bulletin (Vol. 47, No. 32), CBP published a notice that proposes to modify a ruling and similar treatment regarding the tariff classification of bushings used in marine propulsion systems.

Comments on Proposed Revocations Due Aug. 30

CBP said consideration will be given to any written comments received by Aug. 30 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed revocations, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions, or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposed Revocations

CBP is proposing to modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke or modify any treatment it has previously accorded to substantially identical transactions.

Bushings

Item: Plastic Bushings with a Lip. A plastic bushing with a lip or flange that is used in a steering assembly for a marine water-jet propulsion system. The principal function of this component is to provide a smooth interface between the moving surface of the water-jet’s steering arms and the fixed surface of the distance sleeve.
Current: 3926.90.9980, 5.3% (Other articles of plastics, other.)
Proposed: 8483.30.80, 4.5% (Transmission shafts (including camshafts and crankshafts) and cranks; bearing housings, housed bearings and plain shaft bearings; gears and gearing; ball or roller screws; gear boxes and other speed changers, including torque converters; flywheels and pulleys, including pulley blocks; clutches and shaft couplings (including universal joints); parts thereof: Bearing housings; plain shaft bearings: Other.)
Reason: Merchandise is only classified in 3926 when it is not described elsewhere in the nomenclature, said CBP. Because the subject bushing is found to be classified in heading 8483, it's precluded from classification in heading 3926.
