Handouts from BIS' 2010 Export Update Conference Available

During the Bureau of Industry and Security’s Annual Export Controls Update Conference on August 31-September 2, 2010, various officials from BIS, the Census Bureau, the State Department, and other agencies gave presentations on numerous topics.

Most of the presentations included handouts (in PDF or PowerPoint format), which cover the following topics:

NEI. National Export Initiative priorities, Export Promotion Council, President’s Export Council, successes to date.

Forwarder responsibilities. The responsibilities of authorized agents/freight forwarders under the FTR, freight forwarder best practices, criminal and civil penalties, the roles and responsibilities of freight forwarders under the EAR.

Embargoes and sanctions. BIS foreign policy-based controls, U.S. unilateral controls, Office of Foreign Assets Control update on sanctions issues.

ITAR Update. The State Department’s Directorate of Defense Trade Controls DDTC), DDTC licensing statistics, actions taken to implement the NEI, changes to the International Traffic in Arms Regulations since last year’s Update conference, details on commodity jurisdiction activities, DDTC registration requirements.

Encryption workshop. Current scope of Commerce Control List Category 5, Part 2, encryption registration, Encryption Licensing Exception ENC and mass market requirements, grandfathering provisions, and encryption licensing.

Interagency compliance forum. Export Administration Regulations (EAR) compliance measurement, Census’ Foreign Trade Regulations (FTR) compliance measurement.

Export enforcement plenary. Export enforcement statistics, Office of Antiboycott Compliance activities.

Technology transfer. Jurisdiction for technology exports, technology exports and deemed exports, Defense Technology Security Administration (DTSA) mission, structure and licensing process, and exporting critical technology.

Parties to the transaction. U.S. government proscribed lists (i.e., Debarred List, Specially Designated Nationals List, Denied Parties List, the Entity List, and the Unverified List).

End-use check briefings. An overview of end-use checks, DDTC’s “Blue Lantern” end-use monitoring, and DTSA’s end-use monitoring program.

Export control officer briefings. Export control officer briefings on China, Hong Kong, Singapore, India, Russia, and United Arab Emirates.

Cloud computing. BIS’ January 2009 advisory opinion on cloud computing.

Nuclear export controls. Agency jurisdiction, list-based controls, Enhanced Proliferation Control Initiative (EPCI), licensing process and deadlines, Nuclear Regulatory Commission export/import licensing requirements and procedures, Subgroup on Nuclear Export Coordination (SNEC).
