The Commerce Department published notices in the Federal Register May 16 on the following antidumping and countervailing duty (AD/CVD) proceedings (any notices that announce changes to AD/CVD rates, scope, affected firms or effective dates will be detailed in another ITT article):
In a scope ruling released May 7, the Commerce Department said that certain temporary use spare tires imported from China by Logistical Resource Development aren’t subject to antidumping and countervailing duty orders on Chinese passenger vehicle and light truck tires. It has reached similar decisions regarding temporary use tires from Taiwan and Thailand (see 2403120022) and 2401250038).
The Commerce Department has published the final results of its countervailing duty administrative review on corrosion resistant steel from South Korea (C-580-879). These final results will be used to set final assessments of CVD on importers for subject merchandise entered Jan. 1, 2022, through Dec. 31, 2022.
The Commerce Department has published the final results of its countervailing duty administrative review on cold-rolled steel flat products from South Korea (C-580-882). These final results -- only the rate for POSCO affiliates changed, from 1.48% in the preliminary results -- will be used to set final assessments of CVD on importers for subject merchandise entered Jan. 1, 2022, through Dec. 31, 2022.
The Commerce Department said it's partially rescinding the administrative review of the antidumping duty order on certain frozen warmwater shrimp (shrimp) from India (A-533-840) for the period of review Feb. 1, 2023, through Jan. 31, 2024, because a large number of companies had no reviewable, suspended entries of subject merchandise during the review period. Those companies are listed in Appendix II of the notice. Three other companies will not be reviewed because their requests for review were withdrawn. They are named in Appendix I of the notice.
The Commerce Department has published the final results of the antidumping duty administrative review on polyethylene terephthalate film from India (A-533-824). Commerce reversed its preliminary finding that Jindal Poly Films Ltd. didn't undersell subject merchandise during the period of review, flippinging a zero percent AD rate to a facts available rate applied for failure to provide information after the preliminary results were released, in the final results. SRF Limited of India had its rate of 1.15% in the preliminary results changed to zero percent.
The International Trade Commission seeks comments by May 27 on a Section 337 complaint alleging that imports of ink cartridges and components infringe patents held by Epson, it said in a notice set for May 19 publication. According to the complaint, the complainants are seeking a general exclusion order and cease and desist orders against 20 companies, primarily from China, to bar from entry "unauthorized, aftermarket ink cartridges, and components thereof," that violate the complainant's patents. The complainants described the offending products as "substitutes for many of the genuine ink cartridges currently being sold by Epson, including many different cartridge families designed for many different printer models."
The International Trade Commission began a Section 337 investigation into allegations that Acer, ASUS, Hisense and their subsidiaries are importing and selling electronics that infringe patents held by Nokia, the ITC said in a notice to be published May 19. Nokia filed the complaint in April and is seeking a limited exclusion order and cease and desist orders against the respondents to bar from entry "certain video-capable laptop, desktop computers, handheld computers, tablets, televisions, projectors, and components and modules thereof" that violate the complainant's patents (see 2504160003).
Suspension of liquidation and countervailing duty cash deposit requirements take effect May 19 for imports of float glass products from China (C-570-189) and Malaysia (C-557-833), after the Commerce Department found countervailable subsidization in preliminary determinations in its ongoing CVD investigations.
