The State Department has issued a proposed rule to amend the International Traffic in Arms Regulations (ITAR) to revise Category VII of the U.S. Munitions List (tanks and military vehicles) to assign tiers and describe more precisely the defense articles therein.
As part of the President’s export control reform initiative, the State Department’s Directorate of Defense Trade Controls has issued an advance notice of proposed rulemaking (ANPR) which (i) seeks public comment on revisions to the U.S. Munitions List that would make it a “positive list” of controlled defense articles, (ii) requests that the public “tier” defense articles based on the Administration’s three-tier control criteria1, and (iii) requests the public identify those current defense articles that the public believes do not fall within the scope of any of the criteria’s tiers.
At the December 9, 2010 meeting of the President’s Export Council, President Obama announced, among other things, the deployment of the Administration’s export control reform page on the Export.gov Web site (www.export.gov). Newly posted to the Web site is a downloadable file that consolidates export screening lists of the Departments of Commerce, State and the Treasury into one spreadsheet as an aide to industry in conducting electronic screens of potential parties to regulated transactions.
The Directorate of Defense Trade Controls has published the minutes from the Defense Trade Advisory Group's October 20, 2010 Plenary. The minutes include a review of progress on export control reform, and discussion of three proposed International Traffic in Arms Regulations changes which address how to protect the best technologies, share security challenges, and how to prevent adversaries from obtaining these technologies, among other things.
The Directorate of Defense Trade Controls has updated its table of license processing times to include November 2010. The table includes cases received, cases closed, cases open at the end of the month, and average processing time (in calendar days).
