The Federal Trade Commission is giving advance notice that it will propose amendments to its Fur Rules (16 CFR 301) to reflect the March 18 elimination of the fur-content labeling and disclosure exemption for "apparel with fur" that contains relatively small quantities or values of fur. The FTC is also requesting comments on its Fur Act regulations (Fur Rules) and Fur Products Name Guide by May 16, 2011.
Gov.cn reports that the president of China's largest metals trader, China Minmetals, has called for government efforts to consolidate the rare earth industry and nurture competitive domestic firms in the sector. Zhou Zhongshu said that the difficulties facing China's rare earth industry mainly come from the fact that local authorities, owners of rare earth mines, tend to issue mining licenses to local firms. Often small companies churn out low value-added products, which hinders the development of the sector.
The International Trade Administration has issued the preliminary results of the administrative review of the antidumping duty order on certain frozen warmwater shrimp from Vietnam (A-552-802) covering the period February 1, 2009 through January 31, 2010. Interested parties are invited to comment on these preliminary results.
In the May 2007 - April 2008 antidumping duty administrative review of ball bearings and parts thereof from Japan, the International Trade Administration selected only the 4 largest producer/exporters as mandatory respondents and reviewed no others, “due to limited resources.” Asahi Seiko Co., Ltd. challenged the results, arguing that by not being selected for review it was deprived of the chance to possibly earn revocation by demonstrating zero or de minimis margins. However, the court ruled that because it withdrew its request for review when the 4 mandatory respondents were selected (in an attempt to avoid being assigned the “all others” rate), Asahi failed to exhaust its administrative remedies and therefore could not challenge the review results.
