CBP Announces 2-Year Extension of Section 321 Data Pilot

CBP announced a two-year extension of its Section 321 data pilot, through August 2023, in a notice released Aug. 27. “CBP will extend the test for another two years to continue further evaluation of the 321 Data Pilot program and the risks associated with section 321 shipments,” it said. The pilot is still “limited to a maximum of nine participants,” said CBP, which has said it intends to expand the pilot to more participants (see 2108040012).

The pilot had been set to end Aug. 22. Under the pilot, “participants agree to transmit electronically certain data in advance for shipments potentially eligible for release under Section 321 of the Tariff Act of 1930 ... . The data pilot tests the feasibility of collecting data elements, beyond those required by current regulations, and from nontraditional entities, such as online marketplaces,” CBP said.

Despite some indications that the pilot had been set to wrap, CBP announced it would be extending it in June amid calls from the trade community to continue the program (see 2106240064). One early result of the pilot was an announcement by CBP to exempt filers that demonstrate the ability to identify PGA-regulated goods from the requirement to file a 10-digit tariff schedule classification on non-PGA merchandise.
