Aluminum Sheet: Details of AD/CV Duty Orders
The Commerce Department issued antidumping duty orders on common alloy aluminum sheet from Bahrain (A-525-001), Brazil (A-351-854), Croatia (A-891-001), Egypt (A-729-803), Germany (A-428-849), India (A-533-895), Indonesia (A-560-835), Italy (A-475-842), Oman (A-523-814), Romania (A-485-809), Serbia (A-801-001), Slovenia (A-856-001), South Africa (A-791-825), Spain (A-469-820), Taiwan (A-583-867) and Turkey (A-489-839), and countervailing duty orders on common alloy aluminum sheet from Bahrain (C-525-002), India (C-533-896) and Turkey (C-489-840). The orders set permanent antidumping and countervailing duties that will remain in place unless revoked by Commerce, which may only take place under certain conditions, such as a sunset or changed circumstances review. Commerce will now begin conducting annual administrative reviews, if requested, to determine final assessments of AD/CV duties on importers and make changes to cash deposit rates.

The orders detail a “gap period” of no CV duty liability for subject merchandise that was entered Dec. 12, 2020, through April 25, 2021, and of no AD duty liability for subject merchandise entered April 13, 2021, through April 25, 2021. Commerce may only suspend liquidation for a four-month period after its preliminary CV duty determination, issued Aug. 14, 2020, and for six months after its preliminary AD duty determination, issued Oct. 15, 2020. Commerce will order CBP to liquidate, without regard to AD or CV duties, any entries during these respective gap periods. Subject merchandise entered during the CV duty gap period but outside the AD duty gap period (i.e., Dec. 12, 2020, through April 12, 2020) will only be assessed AD duties.
Commerce will order the refund of all CV duty cash deposits collected on common alloy aluminum sheet from Turkey prior to May 16, 2020, and all AD duty cash deposits collected for common alloy aluminum sheet from Indonesia prior to July 17, 2020, because the ITC reversed Commerce's findings of critical circumstances and retroactive collection of cash deposits.
Commerce calculated a zero percent AD duty rate for Manaksia Aluminium in its final determination for India, and for Laminazione Sottile in its final determination for Italy. As a result, merchandise both produced and exported by these two companies are exempt from the AD duty orders on common alloy aluminum sheet from India and Italy, respectively, and are not subject to suspension of liquidation or cash deposit requirements, though Manaksia Aluminium is still subject to suspension of liquidation and cash deposit requirements under the CV duty order on common alloy aluminum sheet from India.
AD/CV Suspension of Liq Instructions
Suspension of liquidation resumes for all entries of subject merchandise entered on or after April 26, the date that the final ITC affirmative injury determination was published.
CV Cash Deposit Instructions
Commerce will require importers to pay CV duty cash deposits on subject merchandise entered on or after April 26. CV duty cash deposits will be required at the following rates (as amended from Commerce's final determination for Canada):

AD Cash Deposit Instructions
An AD cash deposit requirement is also in effect for subject merchandise entered on or after Aug. 25. Commerce will instruct CBP to require, at the same time that importers deposit estimated duties, a cash deposit equal to the rates listed below.
