ITC to Consider General Exclusion Order on Chocolate Milk Powder
The International Trade Commission will consider whether to issue a general exclusion order banning all imports of chocolate milk powder that infringe a trademark held by Meenaxi Enterprise, the ITC said in a Nov. 25 news release announcing the beginning of a Section 337 investigation (ITC Inv. No. 337-TA-1232). Meenaxi alleges that chocolate milk powder is being manufactured in India that infringes its Bournvita trademark, and is being subsequently imported into the U.S. (see 2011030030). The ITC will also consider cease and desist orders against the following respondents to its investigation:
