DTrade2 and MARY will be down for maintenance between 12:00 p.m. July 3 and the morning of July 8 while they're upgraded, the State Department said. The maintenance window “will support integration with USXports for some license adjudication functions. DTrade2 will be unavailable during the period for case submission, and no case adjudication will occur. The Bureau of Industry and Security ordered Billy Powell of Kingwood, Texas, to pay $100,000, and denied his export privileges for five years, for an alleged scheme to export oil and gas equipment parts through the United Arab Emirates to Iran without the required license. According to BIS, an Office of Foreign Assets Control license was required for the shipments. Powell knew a license was required, but didn’t get one. Per the terms of the order, Powell may not export or perform activities related to exporting, until June 19, 2018.
The Bureau of Industry and Security added Shekar Babu to a denial order of export privileges against Enterysys. The BIS previously said Enterysys violated Export Administration Regulations by exporting controlled items to India without the required license (see 12120702). Enterysys was charged with (1) exporting ceramic cloth to India without the required license; (2) evasion; (3) engaging in prohibited conduct by exporting electronic components to a company on the Entity List without a license; and (4) acting with knowledge of a violation. BIS found the company to be in default after it received no response to a charging letter, and no response to an administrative law judge’s recommended decision and order.
The U.S. Postal Service will no longer deliver First-Class mail to the Census Bureau, said Census in an Automated Export System broadcast. According to the message, first class mail includes all personal correspondence, bills, statements of accounts, and “all other matter sealed or otherwise closed against inspection with postage.” The only mail that will be accepted will be the following: standard post, bound printed material, media mail, and library mail. Anyone who has recently mailed something to the Census Bureau’s Foreign Trade Division via the USPS, including Voluntary Self Disclosures and data requests, should contact the Regulations Outreach and Education Branch at (800) 549-0595, option 3, to ensure delivery.
The Bureau of Industry and Security denied export privileges to 10 men for violations of the Arms Export Control Act, all for exporting or attempting to export U.S. Munitions List items -- including semiautomatic rifles, ammunition and magazines -- to Mexico. They all exported or attempted to export the USML items without a license, BIS said. The men are all inmates at various correctional institutions, serving terms anywhere from 37 to 95 months. They are also all named on the State Department’s Debarred List. BIS denied export privileges for 10 years for each of the men: themselves, their representatives or associates are prohibited from exporting or reexporting any technology, commodity or software. The Census Bureau sent out AES Broadcast 2013047 as part of a series of monthly educational broadcast messages on fatal errors in the Automated Export System. The Bureau of Industry and Security published a final rule amending the Commerce Control List based off edits made to Wassenaar List of Dual-Use Goods and Technologies. The rule takes effect June 20. It amends nearly 30 Export Control Classification Numbers, plus edits various Supplements and Parts to the Export Administration Regulations.
The Export-Import Bank needs to improve its risk management and financial performance analysis, given its ballooning exposure to loans in the past several years, said a June 13 Government Accountability Office report. A May 2013 report found "weaknesses” in Ex-Im's exposure forecasting (see 13053106). Another GAO report from March said that Ex-Im has already started addressing recommendations by its Inspector General about portfolio stress testing, thresholds for managing portfolio concentrations, and risk governance. However, these techniques “merit continued attention” for an improved process.
The Department of State is requesting comments by July 13 for a proposed information collection for the Export Declaration of Defense Technical Data or Services. The State Department proposes to extend the expiration date of the currently approved existing information collection.
More small businesses are exporting now compared to three years ago, according to a study released June 13 by the National Small Business Association (NSBA) and its international trade arm the Small Business Exporters Association (SBEA). The study also indicated an increased portion of non-exporters, from 43 percent in 2010 to 63 percent today, expressed interest in exporting their goods or services.
