Census has posted to its Web site, its schedule for its upcoming meetings and presentations on the Automated Export System and other export issues.
Census has issued an Automated Export System (AES) broadcast announcing that Port of Export Code 3901 (Chicago, Illinois) has been updated in the AES effective immediately. “Rail” has been added as a valid method of transportation (MOT) in addition to “Air” and “Truck.”
On January 25, 2012, the Directorate of Defense Trade Controls announced the following entity name and/or address changes for new DDTC license applications (see each notice for specific instructions for currently approved, pending, and new DSP authorizations and agreements, etc.):

SDNs are (i) individuals and companies owned or controlled by, or acting for or on behalf of, targeted countries or (ii) individuals, groups, and entities, such as terrorists and narcotics traffickers designated under programs that are not country-specific. The assets of listed SDNs are blocked and U.S. persons are generally prohibited from dealing with them.

BIS has posted its 2012 Report on Foreign Policy-Based Export Controls, which extends all foreign policy export controls discussed in the report for the period of January 21, 2012 to January 20, 2013. Each chapter of this report describes a particular category of foreign policy controls (e.g., Crime Control/Human Rights, Anti-Terrorism, Regional Stability, Chemical and Biological, Missile Technology, Nuclear Nonproliferation, and Entity List controls, etc.) and delineates modifications that have taken place over the past year1.
The Bureau of Industry and Security has posted the public comments on its proposed rule to add to the Commerce Control List (CCL) certain military vehicles and related items that the President determines no longer warrant control under the U.S. Munitions List (USML). BIS received only two public comments on this proposed rule. The proposed rule would revise USML Category VII (military ground vehicles and related articles) to narrow the articles controlled on the USML and make this list of items more positive. At the same time, BIS re-proposed the creation of five new 600 series ECCNs to control articles removed from Category VII that would instead be controlled by the CCL. This rule does not propose any tiering.
The Bureau of Industry and Security has issued a correction to its January 9, 2012 final rule that imposes a license requirement on exports and reexports to all destinations other than Canada of two types of microwave and millimeter wave electronic components. The two components are packaged high electron mobility transistors (HEMT) and packaged microwave “monolithic integrated circuits” (MMIC) power amplifiers. The correction adds a compliance date of February 9, 2012 in order to provide exporters and reexporters sufficient time to comply. As a result of this change, only exports and reexports on or after February 9, 2012 are affected by the licensing requirement imposed in new ECCNs 3A982, 3D982, and 3E982. (Note that the final rule still took effect on January 9, 2012.)
On January 20, 2012, Mexico's Ministry of Economy announced that Mexico's accession to the Wassenaar Arrangement (WA) was approved by the 40 member countries. This accession implies the recognition of Mexico as a safe country of origin for dual-use goods and high technology and a reliable destination for investment for the production of such goods. The decision in favor of Mexico's WA membership is based on the country's commitment to disarmament and nonproliferation and the effectiveness of its national export controls. As a member, Mexico will have access to new markets and technology, as well as a potential market in high technology exports.
The Food Safety and Inspection Service has issued a proposed rule to amend the meat and poultry inspection regulations to (i) provide for an electronic export application and certification system; (ii) charge a fee for the use of the proposed electronic system; (iii) make meat and poultry export application, certification regulations parallel, where possible; and (iv) provide flexibility in the requirements for official export inspection marks, devices, and certificates. FSIS also proposes to amend the egg product export regulations to parallel, to the extent possible, the export requirements in the meat and poultry regulations that provide for application, certification, and marking of product destined for export.
