FDA has issued its Enforcement Report for Nov. 24, listing the status of recalls and field corrections for food, cosmetics, tobacco products, drugs, biologics and devices. The report covers both domestic and foreign firms.
FDA is adding importers to its import alert for those not in compliance with the Foreign Supplier Verification Program at an ever-increasing rate, with more than half of importers subject to import refusal under the alert added within the last three months.
The International Trade Commission will recommend an extension to Section 201 safeguard tariffs on solar cells that began in 2018, it said Nov. 24. The commission found the safeguard “continues to be necessary to prevent or remedy serious injury to the U.S. industry, and that there is evidence that the domestic industry is making a positive adjustment to import competition.” The ITC said it will submit a report by Dec. 8 to President Joe Biden, who will make a final decision on whether to extend the safeguard duties. Unless extended, the safeguard will expire Feb. 6, 2022.
A protest supplement filed by an importer may not be considered by CBP as a supplement but should be accepted as a new protest, CBP said in a recent ruling. Though the supplement was too late because it came after the relevant protest was denied and addressed an issue not included under the original protest, the supplement otherwise met all requirements for protests filed by CBP, the agency said.

A coalition of anonymous solar companies is “evaluating all options” following the denial of its requests to apply antidumping and countervailing duties on Chinese solar cells to imports from Malaysia, Thailand and Vietnam, it said Nov. 15. The American Solar Manufacturers Against Chinese Circumvention (A-SMACC) said it “strongly” disagrees with the Commerce Department’s rejection of its request for an anti-circumvention inquiry, on the basis that the coalition’s members could not remain anonymous.
The Environmental Protection Agency “showed no flexibility” on an upcoming requirement to submit entry data for imports of hydrofluorocarbons 14 days prior to importation (see 2109230054), despite concerns raised by the National Customs Brokers & Forwarders Association of America at a recent meeting with the agency, the trade group said in an emailed update.
An exporter of wind towers that enters into post-importation warranty and repair agreements with its customers, but does not hold title or risk of loss when the goods are imported, doesn't have a sufficient financial interest in the wind towers to make entry under the customs laws, CBP said in ruling HQ H312266, dated Oct. 29.

The Commerce Department issued Federal Register notices on its recently initiated antidumping investigations on oil country tubular goods from Argentina (A-357-824), Mexico (A-201-856) and Russia (A-821-833) and countervailing duty investigations on oil country tubular goods from South Korea (C-580-913) and Russia (C-821-834).
