China Multilayered Wood Flooring: Amended Final Results of 2019-2020 AD Admin Review

The Commerce Department is amending the final results of an antidumping duty administrative review on multilayered wood flooring from China (A-570-970) based on the final decision in a Court of International Trade case challenging those final results.

In the final results of the AD review (see 2206300035), published July 1, 2022, covering the period Dec. 1, 2019, though Nov. 30, 2020, Commerce assigned mandatory respondent Jiangsu Senmao Bamboo and Wood Industry Co., Ltd. a 39.27% AD rate.

Jiangsu challenged the use of surrogate country data for arriving at the rate. After three remands ordered by the court, the substitution of new surrogate data for data originally used in the calculation resulted in a rate of 14.35% for Jiangsu; that rate was accepted in the final court judgment on Sept. 15, 2025. The new rate is applicable Sept. 25, 2025.

But because Jiangsu has a superseding cash deposit rate, i.e., there have been final results published in a subsequent administrative review, Commerce will not issue revised cash deposit instructions to CBP for Jiangsu, and its current cash deposit rate won't change.

The notice also said that Commerce remains, at this time, "enjoined by CIT order from liquidating entries that were exported by Jiangsu Senmao, and were entered, or withdrawn from warehouse, for consumption during the period from 12/01/2019 through 11/30/2020. These entries will remain enjoined pursuant to the terms of the injunction during the pendency of any appeals process."
