Russia Unwrought Palladium: New AD/CVD Investigations Deadlines & Scope
The Commerce Department recently initiated antidumping duty and countervailing duty investigations on unwrought palladium from Russia (A-821-840/C-821-841). The AD investigation period is Jan. 1, 2025, through June 30, 2025. The CVD investigation period is calendar year 2024.

The International Trade Commission will conduct a concurrent investigation to determine whether imports of dumped and illegally subsidized unwrought palladium are injuring U.S. industry. If the ITC finds no injury in its preliminary injury determination, due Sept. 15 according to a Commerce fact sheet, the investigations will immediately end. If Commerce finds dumping or illegal subsidization in the preliminary determinations of these investigations, due in October for CVD and in January for AD, it will set AD and/or CVD cash deposit requirements for imports of merchandise subject to the investigation. If both Commerce and the ITC reach affirmative final determinations, Commerce will issue an AD and/or CVD order making duties permanent and beginning a process of annual administrative reviews to set final assessments of AD/CVD on importers and potentially set new AD/CVD cash deposit rates.
AD/CVD Respondent Selection
For its CVD investigation, Commerce said it will select respondents for individual examination based on CBP import data. For its AD investigation, Commerce said it will pick respondents for individual examination by issuing quantity and value questionnaires to the largest producers and/or exporters that are identified in CBP entry data and have complete address information on the record.
Exporters that don't get a quantity and value questionnaire can submit one using the forms available on Commerce's website. Responses are due Sept. 2 at 5 p.m. ET.
Companies subject to the AD investigation also will have to submit a separate rate application to avoid getting the high Russia-wide rate. Separate rate applications will be due 21 days from the publication date of Commerce's AD initiation notice (i.e., Sept. 12).
Scope of the AD/CVD Investigations
"The scope of this investigation is unwrought palladium. Unwrought palladium includes palladium, whether or not refined, in the form of ingots, blocks, lumps, billets, cakes, slabs, pigs, cathodes, anodes, briquettes, cubes, sticks, grains, sponge, pellets, shot, powder, and similar primary forms.
"Unwrought palladium is covered by the scope regardless of production method. The scope includes unwrought palladium produced through ore extraction, unwrought palladium produced by recycling palladium-containing scrap, unwrought palladium produced by any other method, and blends of unwrought palladium produced by different methods.
"The scope includes unwrought palladium that is commingled with unwrought palladium from sources not subject to this investigation or commingled with other metals. Only the subject unwrought palladium component of such commingled products is covered by the scope of this investigation.
"Subject merchandise includes merchandise matching the above description that has been finished, packaged, or otherwise processed in a third country, including by refining, grinding, commingling, adding or removing additives (such as other metals), or performing any other finishing, packaging, or processing that would not otherwise remove the merchandise from the scope of the investigation if performed in the subject country.
"The covered merchandise is currently classified in the Harmonized Tariff Schedule of the United States (HTSUS) at subheading 7110.21.0000. Unwrought palladium meeting the scope description may also enter under HTSUS subheading 7110.29.0000. Although the HTSUS subheadings are provided for convenience and for customs purposes, the written description of the subject merchandise is dispositive."
Comments on the scope of these investigations are due by 5 p.m. ET on Sept. 8.
