China Overhead Door Springs: Commerce Issues AD Final Determination

The Commerce Department has released its final determination in the antidumping duty investigation on overhead door counterbalance torsion springs from China (A-570-186). Cash deposit rates set in this final determination take effect Aug. 15.

The next step is for the International Trade Commission to make its final injury determination. If the ITC finds injury, Commerce will issue an AD order and duties will be made permanent. If the ITC finds no injury, the investigation will be terminated and all cash deposits will be refunded.

Commerce also issued its final determination in the concurrent countervailing duty investigation on overhead door springs from China, with CVD rates set at 257.46% for all Chinese companies (see 2508140034). Collection of CVD is on hold pending the ITC's final injury determination. Commerce also is conducting ongoing AD/CVD investigations on overhead door springs from India.

Critical Circumstances for Some Chinese Companies, Cash Deposits Retroactive 90 Days

Commerce continued to find that the China-wide entity -- which includes all producer-exporter combinations that didn't get their own individual AD rates in this investigation -- increased its exports to the U.S. in the run-up to the preliminary determination. As a result, the agency will continue to direct CBP to retroactively suspend liquidation and require AD duty cash deposits for subject merchandise from the China-wide entity 90 days before the preliminary determination, i.e., March 4, 2025.

Suspension of liquidation and CVD cash deposit collection is in effect even earlier, i.e., as of Jan. 3, 2025, for seven companies for which Commerce found critical circumstances in its concurrent CVD investigation: Foshan Nanhai Xulong Spring Factory; Tianjin Wangxia Spring Co., Ltd.; Beled Co., Ltd./Beled (Shenxhen) Commerce Co., Ltd.; Jiaxing Taike Springs Co., Ltd; Kowloon Metal Spring Factory; Ningbo I Promise Import Export; and Xiamen Globe Truth GT Industries.

Commerce will instruct CBP to continue to suspend liquidation for AD purposes and collect cash deposits for subject merchandise entered on or after the dates listed below, and set cash deposit rates as follows:
