CBP Guidance Provides HTS Code for Brazilian Imports Subject to 40% Duty
CBP recently offered guidance on how customs brokers and importers should apply 40% duties on goods imported from Brazil, following the White House's implementation of stiffer tariffs on the country (see 2507300066).

The new additional 40% duty on some imports from Brazil comes on top of the 10% reciprocal tariff. The new duties won't apply to goods that are loaded before 12:01 a.m. EDT Aug. 6 and are in transit when the action begins, as long as they enter before 12:01 a.m. EDT Oct. 5.
According to CBP's Aug. 1 cargo systems message, the new HTS classification codes are as follows:
9903.01.77: All imports of articles that are products of Brazil, other than products classifiable under headings 99903.01.78-9903.01.83 and other than products for personal use included in accompanied baggage of persons arriving in the United States, will be assessed an additional ad valorem rate of duty of 40%.
Some goods are exempt, including products of Brazil that are subject to Section 232 duties. These include steel, aluminum, copper, lumber, autos, and semiconductors. For exempt goods, the HTS classifications are:
9903.01.78: Brazilian products that (1) were loaded onto a vessel at the port of loading and in transit on the final mode of transit prior to entry into the United States, before 12:01 a.m. EDT on Aug. 6; and (2) are entered for consumption or withdrawn from warehouse for consumption before 12:01 a.m. EDT on Oct. 5.
9903.01.79: Donations of articles, such as food, clothing, and medicine.
9903.01.80: Informational materials, including but not limited to, publications, films, posters, phonograph records, photographs, microfilms, microfiche, tapes, compact disks, CD ROMs, artworks, and newswire feeds.
9903.01.81: Products identified in Annex I of the Executive Order and classified in the subheadings enumerated in subdivision (x)(iii) of note 2 to subchapter III of chapter 99 of the HTSUS, which was added to the HTSUS by Annex II of the Executive Order. The articles subject to 9903.01.81 are products other than civil aircraft.
9903.01.82: Articles of civil aircraft (all aircraft other than military aircraft); their engines, parts, and components; their other parts, components, and subassemblies; and ground flight simulators and their parts and components.
9903.01.83: Articles of iron or steel, derivative articles of iron or steel, articles of aluminum, derivative articles of aluminum, passenger vehicles (sedans, sport utility vehicles, crossover utility vehicles, minivans, and cargo vans) and light trucks and parts of passenger vehicles (sedans, sport utility vehicles, crossover utility vehicles, minivans, and cargo vans) and light trucks, and semi-finished copper and intensive copper derivative products, the product of Brazil.
