India Off-Road Tires: Prelim Results of AD/CVD Admin Reviews

The Commerce Department has published the preliminary results of its antidumping and countervailing duty administrative reviews on certain new pneumatic off-the-road tires from India (A-533-869/C-533-870). In the final results of these reviews, Commerce will set AD assessment rates for subject merchandise for the companies under review entered March 1, 2023, through Feb. 29, 2024, and CVD assessment rates for entries Jan. 1, 2023, through Dec. 31, 2023.

Commerce said it's rescinding the AD review for 14 companies because they had no reviewable, suspended entries of subject merchandise during the AD review period (see Appendix III of the AD notice for the list of companies).

Liquidation 'as Entered' for Entries From Exporters Not Subject to Reviews

Only the exporters for which an administrative review was requested are covered by these reviews. Cash deposit rates for all other exporters will not change. Commerce has ordered liquidation “as entered” for entries during the periods of review from all exporters for which a review was not requested (ADCVDWeb Message #s 4166406, 4172403).

Antidumping Duty Cash Deposit Requirements

New AD cash deposit requirements may take effect beginning on the date of publication of the AD final results in the Federal Register. Commerce preliminarily calculated the following AD cash deposit rates:

Review average rate. The review average AD rate is applicable to the 10 companies that were not individually reviewed. They are listed in Appendix II of the AD notice.

CV Duty Cash Deposit Requirements

New CVD cash deposit requirements may take effect beginning on the date of publication of the CVD final results in the Federal Register. Commerce preliminarily calculated the following CVD cash deposit rates:

Review average rate. The review average CVD rate is applicable to 33 companies that were not individually reviewed (see Appendix II of the CVD notice for the list of those companies).

Assessment Rates

If these preliminary results are confirmed in the final results, importers of subject merchandise exported by ATC and its affiliates during the period March 1, 2023, through Feb. 29, 2024, will be assessed AD duties at importer-specific rates. Entries from Asian Tire/Lallypur won't be assessed AD. Importers from the other companies under review will be assessed AD at the rates listed above. In the final results, Commerce also will set CVD assessments for importers of subject merchandise entered in calendar year 2023.
