Vietnam Shrimp: Prelim Results of AD Admin Review
The Commerce Department has published the preliminary results of its antidumping duty administrative review on frozen warmwater shrimp from Vietnam (A-552-802). The agency preliminarily determined that 24 companies under review qualify for a separate rate, and another 146 companies didn't, making the second set of companies part of the Vietnam-wide entity that is subject to the Vietnam-wide entity rate of 25.76%.

Commerce also is rescinding this review with respect to 11 companies that have qualified for a separate rate but haven't entered subject merchandise during the review period. Commerce also is rescinding the review for Trang Khanh Seafood Co., Ltd., part of the Vietnam-wide entity, because it had no reviewable, suspended entries during the period of review. See Appendix IV of the notice for a list of the 11 companies. The cash deposit rates currently in effect for these companies won't change, and any entries during the period of review reported under their case numbers will be assessed duties at the calculated separate rate or the 25.76% Vietnam-wide rate, respectively.
There are 170 companies remaining in the review, with the 146 Vietnam-wide entity companies (see Appendix III of the notice for a complete list of the companies) and another 24 companies with separate-rate status.
Only the 170 exporters of subject merchandise for which an administrative review was requested are covered by this review. Cash deposit rates for all other exporters will not change. Commerce has ordered liquidation "as entered" for entries during the period of review from all exporters for which a review was not requested or the request was withdrawn, in messages to CBP (ADCVDWeb Message # 4137402).
Cash Deposit Requirements
Once Commerce issues its final results, new AD cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following AD cash deposit rates:

Assessment Rates
In its final results, Commerce will set assessments on importers of AD for subject merchandise entered Feb. 1, 2023, through Jan. 31, 2024. If these preliminary results are adopted unchanged, Commerce will assess duties at 25.76% for importers from 146 Vietnam-wide companies. Soc Trang Seafood entries will be assessed AD at importer-specific rates, and entries from Thong Thuan won't be assessed AD. Separate rate companies not selected as mandatory respondents, 22 in all, will be assessed AD at the rate listed above.
