Roof Tiles Not Covered by AD/CVD on Ceramic Tiles on China

Roof tiles imported by WJC aren’t covered by antidumping duty and countervailing duty orders on ceramic tile from China, the Commerce Department determined in a May 23 scope ruling. The orders don’t cover roofing tiles, it reiterated.

WJC’s tiles are imported as part of a kit that, when assembled, forms “a stylized Chinese-style roof,” the scope ruling said. It said the tiles range in thickness from 2.5 cm to 3.5 cm, although the importer “states that the functional or estimated thickness of each tile is less than 3.2 cm,” it said.

The AD/CVD orders cover ceramic tiles that are less than 3.2 cm thick and used as flooring, wall coverings or outdoor pavers. More specifically, products covered by the orders are “ceramic flooring tile, wall tile, paving tile, hearth tile, porcelain tile, mosaic tile, flags, finishing tile, and the like.”

Commerce said it looked at the language of the orders, as well as the product descriptions from the AD/CVD petitions and investigations, to make its determination. It noted that the domestic petitioner, in comments on the scope ruling, argued that the tiles were “finishing tiles,” but it disagreed. It noted that it had previously found roofing tiles to be out-of-scope in another ruling, Landscape Associates.
