AGOA Country Eligibility Comments Open

The Office of the U.S. Trade Representative is soliciting comments on whether African countries eligible for the African Growth and Opportunity Act benefits should continue to be eligible for AGOA in 2026. (Congress has to renew AGOA before then, as the whole program expires at the end of September.)

The Federal Register notice says eligibility is predicated on countries having established, or making progress toward establishing:

  • A market-based economy.
  • The rule of law.
  • Political pluralism.
  • The right to due process.
  • The elimination of barriers to U.S. trade and investment.
  • Economic policies to reduce poverty.
  • A system to combat corruption and bribery.
  • Protection of internationally recognized worker rights.

Comments and requests to testify may be submitted at regulations.gov, docket number USTR-2025-0012, and must be submitted before midnight EDT on June 30. A public hearing will be held July 18.
