According to the ruling, HQ H338728, which has yet to be entered into the customs rulings database, Global Industries had asked CBP on April 10, 2024, about the country of origin for two models of meeting tables, the Kadin table and the Terina table.
While the Kadin model's laminate table surfaces and wood veneer surfaces are from Canada, the aluminum table legs, extruded aluminum connectors and injection-molded plastic components used to assemble the table frames are manufactured in China before being shipped to Canada. All the table components are packaged and shipped to a U.S. government agency, who is the ultimate customer.
The table surfaces and components of the Terina model follow a similar sourcing pattern to the Kadin model.
CBP ruled that the country of origin for the two table models is Canada because, "as CBP has historically found, it is the tabletop component, which provides the tables with their functionality and accounts for the majority of their weight, visual appeal, and utility, that imparts the essential character of a table. Accordingly, the tabletop component of the Kadin and Terina table configurations that are manufactured in Canada imparts the essential character of the imported meeting table configuration."
As a result, the country of origin of the entire unassembled Kadin and Terina table configurations as imported will be Canada for purposes of U.S. government procurement, CBP said.
