EPA Delays Data Submission Period for PFAS Reporting Rule to April 2026

The EPA has issued an interim final rule amending the data submission period for the Toxic Substances Control Act's perfluoroalkyl and polyfluoroalkyl substances (PFAS) reporting rule, claiming that it needs to have adequate software in place before it can start collecting data, it said in a Federal Register notice.

The start date for submitting data is set for April 13, 2026, and the period will end on Oct. 13, 2026, with an alternate end date of April 13, 2027, for small manufacturers reporting exclusively as article importers, EPA said.

"The Agency is taking this action in response to constraints on the timely development and testing of the software being developed to collect information pursuant to this reporting rule (i.e., the rule's reporting application)," EPA said. This change is necessary because EPA requires more time to prepare the reporting application to collect this data, the agency continued.

The regulation, promulgated in October 2023, requires PFAS manufacturers and importers in any year between 2011 and 2022 to report certain data to EPA related to exposure and environmental and health effects, according to the EPA.

The agency also noted that it could reopen other aspects of this rule for public comments in a future separate action in light of President Donald Trump's executive order calling for deregulation, although for now, the submission period dates are the only aspects of the rule up for change.

This interim final rule is effective on May 13, and comments must be received no later than June 12.
