Commerce Sets Retroactive AD/CVD on Acidic Solid HEDP From China

Retroactive suspension of liquidation and antidumping and countervailing duty cash deposit requirements take effect for acidic solid 1-hydroxyethylidene-1, 1-diphosphonic acid from China entered on or after Dec. 19, 2024, the Commerce Department said in the preliminary determination of an anti-circumvention inquiry.

Commerce found imports of imports of 1-hydroxyethylidene-1, 1-diphosphonic acid, also referred to as hydroxyethylidenendiphosphonic acid, hydroxyethanediphosphonic acid, acetodiphosphonic acid, and etidronic acid, in solid or powder form, are circumventing the AD/CVD orders on 1-hydroxyethylidene-1, 1-diphosphonic acid from China (A-570-045/C-570-046).

Suspension of liquidation and cash deposit requirements are now in effect as of the date Commerce began its circumvention inquiry (see 2412190026).

The company that had requested the anti-circumvention inquiry had alleged that "acidic solid HEDP constitutes merchandise altered in form or appearance in such minor respects that it should be included within the scope of the Orders," Commerce said.

Eleven Chinese companies didn't respond to Commerce's questionnaires, leading the agency to automatically assume that they were exporting acidic solid HEDP and that the product was circumventing the AD/CVD orders.
