China Light Rectangular Pipe: Final Results of AD/CVD Admin Reviews
The Commerce Department has released the final results of the antidumping and countervailing duty administrative reviews on light-walled rectangular pipe and tube from China (A-570-914/C-570-915). These final results will be used to set final assessments of AD/CVD on importers for subject merchandise entered Aug. 1, 2022, through July 31, 2023, for AD and in calendar year 2022 for CVD.

Commerce said it upheld in the final results its preliminary finding that the Vietnamese company Hoa Phat Steel Pipe Company Limited had no shipments of subject merchandise during the AD and CVD review periods.
The agency also continued to find that Hoa Phat will be eligible to participate in the certification program previously established with respect to the AD and CVD orders on light-walled rectangular pipe and tube from China. In November 2023, Commerce found Vietnamese light-walled rectangular pipe and tube imports made from Chinese hot-rolled steel are circumventing the AD/CVD orders on China (see 2311080033). Companies that certify their light-walled rectangular pipe and tube from Vietnam isn't made from Chinese hot-rolled steel aren't subject to AD/CVD.
For exporters of subject merchandise that were not under review (i.e., all except Hoa Phat), cash deposit rates remain at the level set in the most recent review of each respective company. If the exporter has never been assigned its own AD or CVD rate but the manufacturer has, the AD or CVD rate assigned to the manufacturer applies. For merchandise manufactured and exported by companies that have never been assigned an AD or CVD cash deposit rate by Commerce, the AD China-wide rate or the CVD all-others rate applies, respectively.
New Cash Deposit Rates Take Effect May 5
For entries on or after May 5, the date of scheduled publication of the final results of each review in the Federal Register, Commerce is setting new AD and CVD cash deposit rates for subject merchandise produced or exported by Hoa Phat Steel Pipe Company Limited, the only company subject to this review.
AD Cash Deposits:
If the exporter or the importer fails to properly certify that an entry of light-walled rectangular pipe and tube produced by Hoa Phat was not produced using China-origin hot-rolled steel, then Commerce said it intends to instruct CBP to suspend the liquidation of the entry of such light-walled rectangular pipe and tube under CBP case number A-552-914-001 and require a cash deposit for estimated AD at the rate of 255.07% (i.e., the China-wide entity rate).
If the exporter and the importer properly certify that an entry of light-walled rectangular pipe and tube produced by Hoa Phat in Vietnam was not produced using China-origin hot-rolled steel, then Commerce said it intends to instruct CBP to suspend the liquidation of the entry of such light-walled rectangular pipe and tube under CBP case number A 552-863-000 and require a cash deposit for estimated AD at a rate of 18.05%, unless both the importer and the exporter have also certified that the entry was not produced from Taiwan-origin hot-rolled steel.
If the exporter and the importer properly certify that an entry of light-walled rectangular pipe and tube produced by Hoa Phat in Vietnam was not produced using China-origin or Taiwan-origin hot-rolled steel, then Commerce sad it intends to instruct CBP to suspend the liquidation of the entry of such light-walled rectangular pipe and tube under CBP case number A-552-859-000 and require a cash deposit for estimated AD at a rate of 15.79%, unless both the importer and the exporter have also certied that the entered product was not produced from South Korea-origin hot-rolled steel.
If the exporter and the importer properly certify that an entry of light-walled rectangular pipe and tube produced by Hoa Phat in Vietnam was not produced using China-, Taiwan-, or South Korea-origin hot-rolled steel, then Commerce said it intends to instruct CBP that the entry is not subject to the AD orders for any of the three countries.
CVD Cash Deposit:
If the exporter or the importer fails to properly certify that an entry of light-walled rectangular pipe and tube produced by Hoa Phat in Vietnam was not produced using China-origin hot-rolled steel, then Commerce intends to instruct CBP to suspend the liquidation of the entry of such light-walled rectangular pipe and tube under CBP case number C-552-915-001 and require a cash deposit for estimated CVD at the rate of 15.28% percent.
If the exporter and the importer properly certify that an entry of light-walled rectangular pipe and tube produced by Hoa Phat in Vietnam was not produced using China-origin hot-rolled steel, then Commerce said it intends to instruct CBP that the entry is not subject to the CVD order.
Assessment Rates for Entries August 2022 - July 2023 and January-December 2022
Commerce will also calculate the AD and CVD it will assess on importers for entries of subject merchandise entered between Aug. 1, 2022, and July 31, 2023, and Jan. 1, 2022, and Dec. 31, 2022, respectively.
All entries of the subject merchandise from Vietnam produced or exported by Hoa Phat and entered into the U.S. during the review period were suspended under the China AD order on light-walled rectangular pipe and tube. Because Commerce found that all the suspended entries produced or exported by Hoa Phat during the review period aren't subject to the AD orders for China, South Korea or Taiwan, it said it will instruct CBP to liquidate such entries without regard to antidumping duties. In the CVD investigation, Commerce adopted the eligibility established in the AD investigation, therefore it will also instruct CBP to liquidate such entries of light-walled rectangular pipe and tube from Hoa Phat without regard to CVD.
