EPA Again Postpones Effective Date of Final Rule Governing TCE Use

The EPA has pushed back by 90 days the effective date of a rule aimed at banning trichlorethylene amid lawsuits in federal court over some of its regulatory provisions, according to a Federal Register notice.

EPA had previously extended the effective date to March (see 2501270036). The original effective date was Jan. 16 (see 2412170020). The new date is June 20, according to the notice.

TCE has numerous uses, including in rocket booster nozzle production and rocket engine cleaning, asphalt testing and recovery, and operations related to aerospace and naval machine maintenance, EPA said in December.

But EPA received 13 petitions for review of the final rule in various circuits of the U.S. Courts of Appeals from groups such as Alliance for a Strong U.S. Battery Sector and Microporous, which argued that interim workplace conditions are impracticable as prescribed under certain regulatory provisions of the rule, causing the rule to function like a total ban.
