ITC Begins Section 337 Investigation on Nasal Irrigation Devices
The International Trade Commission is beginning a Section 337 investigation on nasal devices (ITC Inv. No. 337-TA-1444) after receiving allegations filed by Aardvark Medical Inc. that five Chinese and two U.S. companies are importing products that infringe its patents, the agency said in a March 26 notice.

In a complaint filed in February (see 2502240009), Aardvark said the respondents are importing products that infringe the patent on “certain nasal devices and components thereof.” The complainant describes the product at issue as "a portable handheld nasal irrigation and aspiration device configured to aspirate and irrigate the nasal cavity. The nasal irrigation and aspiration device has reservoirs for the irrigant and aspirant."
The ITC will consider a limited exclusion order and cease and desist orders against the respondents.
