DOE Proposes to Reverse Course, Find 'Gas Products' Not Subject to Energy Standards

The Department of Energy is proposing to withdraw a prior determination that miscellaneous gas products, which are comprised of decorative hearths and outdoor heaters, would qualify as covered products for the purposes of energy effiency standards, according to a Federal Register notice.

By withdrawing this determination, DOE wouldn't need to establish test procedures and energy conservation standards for decorative hearths and outdoor heaters.

DOE is accepting comments on this proposed withdrawal through April 14.

DOE said the impetus to withdraw the rule comes from the Jan. 20 executive order "Unleashing American Energy," in which "all regulatory requirements related to energy are grounded in clearly applicable law and that the American people's freedom to choose from a variety of goods and appliances is not restricted."
