ITC Begins Section 337 Investigation on Shapewear Garments
The International Trade Commission is beginning a Section 337 investigation on shapewear garments (ITC Inv. No. 337-TA-1436) after receiving allegations filed by Spanx that U.S. companies Honeylove Sculptwear, Daerwene and Dolce Vita Intimates and three Chinese companies are importing products that infringe its patents, the agency said in a Jan. 31 news release.

In a complaint filed in December (see 2501060033), the complainants said the respondents are infringing "six Spanx patents related to shapewear garments that utilize specialized fabric covering the abdominal region and strips of fabric extending laterally to create an X shaped pattern over the wearer’s abdominal region, providing compression." The ITC will consider a general exclusion order and cease and desist orders against the respondents.
