China Solar Cells: Amended Final Results of 2020 CVD Admin Review
The Commerce Department has published amended final results of the countervailing duty administrative review on crystalline silicon photovoltaic cells, whether or not assembled into modules, from China (C-570-980), originally published July 11, 2023, to align with the final decision in a court case that challenged a rate in those results.

In that review, Risen Energy Co., Ltd. and its affiliated companies was assigned a CVD rate of 14.27% for subject goods entered during calendar year 2020. After the final results were published, Commerce made a ministerial correction to the final results on Aug. 11. 2023, which made the CVD rate for Risen rise to 18.95%.
Risen appealed both results at the Court of International Trade.
A Dec. 18, 2024, court decision finalized a recalculation by Commerce that resulted in Risen and its affiliates receiving a revised CVD rate of 13.49%. That new final rate is applicable Dec. 28, 2024.
Risen's cross-owned companies are: Risen Energy (Luoyang) Co., Ltd.; Risen Energy (Wuhai) Co., Ltd.; Risen Energy (Changzhou) Co., Ltd.; Risen Energy (Ningbo) Co., Ltd.; Risen Energy (Yiwu) Co., Ltd.; Zhejiang Boxin Investment Co., Ltd.; Zhejiang Twinsel Electronic Technology Co., Ltd.; Jiangsu Sveck New Material Co., Ltd.; Changzhou Sveck Photovoltaic New Material Co., Ltd. (including Changzhou Sveck Photovoltaic New Material Co., Ltd. Jintan Danfeng Road Branch); Changzhou Sveck New Material Technology Co., Ltd.; Ninghai Risen Energy Power Development Co., Ltd.; Risen (Ningbo) Electric Power Development Co., Ltd.; Changzhou Jintan Ningsheng Electricity Power Co., Ltd.; and Risen (Changzhou) Import and Export Co., Ltd.
Because Risen doesn't have a superseding cash deposit rate, Commerce will issue revised cash deposit instructions to CBP using this rate.
Commerce said that, at this time, it remains enjoined by the CIT order from "liquidating entries that: were produced and/or exported by Risen, and were entered, or withdrawn from warehouse, for consumption during the period January 1, 2020 through December 31, 2020. These entries will remain enjoined pursuant to the terms of the injunction during the pendency of any appeals process."
