China Quartz Surface Products: Final Results of AD/CVD Admin Reviews on Malaysia

The Commerce Department has released the final results of its antidumping and countervailing duty administrative reviews on quartz surface products from China (A-570-084/C-570-085). Commerce said it continued its preliminary determination that certain Malaysian exporters of certain quartz surface products continue to be ineligible to participate in the scope certification process established for the AD and CVD orders on quartz surface products from China for all imports of quartz surface products from Malaysia. Specifically, it said it still finds "that these Malaysian exporters did not demonstrate that the quartz slab used to produce their exports" to the U.S. was sourced from "a country other than China."

The Malaysian companies subject to the determination are Bada Industries, Karina Stone, Unique Stone Sdn. Bhd., and Universal Quartz.

Commerce will set AD/CVD assessments on entries from Malaysian companies. For the period Nov. 4, 2021, through Dec. 31, 2022, the agency will instruct CBP to liquidate any entries for the exporters under review at 371.47%, the combination of the China-wide rate established in the AD investigation and the all-others rate established in the CVD investigation. For the period Jan. 1, 2023, through June 30, 2023, Commerce will instruct CBP to liquidate any entries for the exporters under review at 326.15%, the China-wide rate established in the AD investigation.

For the Malaysian exporters subject to this review (i.e., Bada Industries, Karina Stone, Unique Stone, and Universal Quartz), Commerce will instruct CBP to require AD cash deposits equal to the current China-wide rate (i.e., 326.15%). For the same four companies, Commerce also intends to instruct CBP to collect cash deposits of estimated CVD at the current all-others rate (i.e., 45.32%).
