BIS to Solicit Comments on Possible ICTS Import Restrictions for Drones

The Bureau of Industry and Security is drafting an advance notice of proposed rulemaking that could lead to new import restrictions on certain drones and drone parts from China and other countries of concern.

The prerule, sent to the Office of Information and Regulatory Affairs Nov. 12, will seek public comments about potential restrictions on certain “unmanned aerial systems” under the Information and Communications Technology and Services Supply Chain executive order, the same authorities BIS is using to put in place new import restrictions on certain Chinese connected vehicles (see 2409220002 and 2410290026). BIS said it will ask for feedback about the information and communications technology and services “integral” to those unmanned aircraft that are designed, made or supplied by people or companies connected to certain foreign adversaries, including China, Cuba, Iran, North Korea, Russia and Venezuela.

“This ANPRM will assist BIS in determining the technologies and market participants most appropriate for regulation” under its ICTS authorities, the agency said.
