Mattresses: Details of AD Orders on India, Kosovo, Mexico and Spain

The Commerce Department issued antidumping duty orders on mattresses from India (A-533-919), Kosovo (A-803-001), Mexico (A-201-859) and Spain (A-469-826). The orders detail a “gap period” of Aug. 28 - Sept. 3, 2024, of no AD duty liability.

This order sets permanent AD on mattresses from India, Kosovo, Mexico and Spain. Duties will remain in place unless revoked by Commerce, which may take place only under certain conditions, such as a sunset or changed circumstances review. Commerce will now begin conducting annual administrative reviews, if requested, to determine final assessments of AD on importers and make changes to AD cash deposit rates.

Commerce already issued AD orders in its concurrently conducted AD investigations on Bosnia and Herzegovina, Bulgaria, Myanmar, Italy, the Philippines, Poland, Slovenia and Taiwan (see 2407160012). The agency previously ended its countervailing duty investigation on Indonesia without issuing a CVD order (see 2407170010).

Gap Period of No AD Suspension of Liq or AD Duties for Aug. 28 - Sept. 3

For these investigations, the six-month provisional measures period for which the AD suspension of liquidation may remain in effect before the order is issued began on March 1, 2024, the date of the preliminary determinations, and ended on Aug. 27, 2024.

As the ITC's final affirmative injury determination was published Sept. 4, Commerce is instructing CBP to terminate AD suspension of liquidation and to liquidate, without regard to AD, unliquidated entries of subject merchandise entered on or after Aug. 28 and through Sept. 3 (the gap period).

(For subject merchandise from India, Kosovo, Mexico and Spain entered March 1, 2024, through Aug. 27, 2024, AD suspension of liquidation and AD liability remains in effect.)

AD Suspension of Liq, Cash Deposit Instructions

Suspension of liquidation resumes for all entries of subject merchandise entered on or after Sept. 4, the date that the final ITC affirmative injury determination was published. AD cash deposit requirements also resume as of that date. Commerce will instruct CBP to require, at the same time that importers deposit estimated duties, a cash deposit equal to the AD rates listed below:
