Petitioner Seeks 90-Day Retroactive AD/CVD on Thailand and Vietnam

Antidumping and countervailing duties on solar cells from Thailand and Vietnam could take retroactive effect for entries back to June 2024, under a critical circumstances request filed Aug. 15 by the American Alliance for Solar Manufacturing Trade Committee as part of the Commerce Department’s ongoing AD/CVD investigations on solar cells from the two countries (A-549-851/C-549-852, A-552-841/C-552-842).

The domestic producer coalition, which requested the AD/CVD investigations, as well as those on Cambodia and Malaysia (see 2404240071), alleges Thai and Vietnamese companies are increasing exports in advance of Commerce’s preliminary determinations, currently due in late September for CV duties (see 2407030043). The AD preliminary determinations are due in early October, though they could be postponed (see 2405170026).

If Commerce grants the request, duties would be made retroactive 90 days prior to the publication date of the respective preliminary determinations. The American Alliance for Solar Manufacturing Trade Committee seeks expedited treatment for its request, urging Commerce to reach a decision by the time the agency issues its preliminary AD determination.

The domestic group didn’t request retroactive duties for Cambodian and Malaysian solar cells.
