Taiwan Steel Nails: Prelim Results of AD Admin Review

The Commerce Department has published the preliminary results of its antidumping duty administrative review on steel nails from Taiwan (A-583-854). Rates calculated in this review will be used to set assessment rates for importers of subject merchandise from 23 exporters remaining in the review that was entered July 1, 2022, through June 30, 2023.

Only the exporters for which an administrative review was requested are covered by this review. Cash deposit rates for all other exporters will not change. Commerce has ordered liquidation “as entered” for entries during the period of review from all exporters for which a review was not requested or the request was withdrawn (AD/CVDWeb Message # 3290410).

Commerce said it is rescinding the review for Team Builder Enterprise, Ltd., Your Standing International Inc., World Kun Co., Ltd., Shang Jeng Nail Co. Ltd., and Right Source Co., Ltd., because all requests for administrative review were withdrawn. See Appendix I of the notice for a list of 149 companies for which Commerce is rescinding this review; the five companies appear on that list.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for the 23 companies remaining under review, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following AD duty rates:

Non-individually examined companies. Commerce is not individually investigating 17 companies subject to this review and instead preliminarily assigned them the all-others rate. See Commerce's notice, Appendix II, for a full list of these companies.

No shipments. Based on the information provided by Concord International Engineering & Trading Co., Ltd. and Wiresmith Industrial Co., Ltd., Commerce said it preliminarily determined that the two companies were not the first parties in the transaction chain to have knowledge that the subject merchandise was destined for the United States and, thus, Wiresmith and Concord International are not considered the exporters of subject merchandise during the review period for purposes of this review. Therefore, the two companies had no reviewable sales of nails from Taiwan during the review period. They will remain under review for final results. Six other companies were preliminarily determine to have made no shipments of subject merchandise during the review period as well: Astrotech Steels Private Limited, Tag Fasteners Sdn. Bhd., Jinhai Hardware Co., Ltd., Region System Sdn. Bhd., Region Industries Co., Ltd., and Region International Co., Ltd. If Commerce continues these findings in its final results, cash deposit requirements for these eight companies will not change as a result of this review. Any entries under their case numbers will be liquidated at the 26.28% all-others rate.

Assessment Rates

As part of this administrative review, Commerce will also calculate final AD duty assessments on importers of subject merchandise from the companies under review that was entered between July 1, 2022, and June 30, 2023. If these preliminary results are confirmed in the final results, importers of subject merchandise from the companies will be assessed AD at the rates listed above.
