Exporter Says Phragmites Goods Not Subject to AD/CVD Orders on Wood Furniture
Exporter Nanjing Kaylang Co. filed a complaint at the Court of International Trade on Feb. 20 contesting a Commerce Department scope ruling that found Kaylang's products made from phragmites are subject to the antidumping and countervailing duty orders on wooden cabinets and vanities from China (Nanjing Kaylang Co. v. United States, CIT # 24-00045).

The complaint said that the orders are "limited by the words in the scope to articles made of wood and bamboo." Kaylang said its products are made from phragmites, which is a category of reed grasses and not wood. "Phragmites are not trees," and the product made from phragmites is not wood, the complaint said.
As a result, any product made from phragmites is "expressly outside of the scope of the orders," the brief said, and Commerce's scope decision violates the direct language of the orders' scope.
