Vietnam Shrimp: Final Results of AD Admin Review

The Commerce Department has released the final results of the antidumping duty administrative review on frozen warmwater shrimp from Vietnam (A-552-802). Commerce determined that no companies under review qualify for a separate rate, making them part of the Vietnam-wide entity, and subject to the Vietnam-wide entity rate of 25.76%. Commerce will assess AD at this rate on subject merchandise from these 118 companies entered Feb. 1, 2022, through Jan. 31, 2023. A new 25.76% cash deposit rate takes effect for these 118 companies on Feb. 14, when these final results are to be published in the Federal Register.

Commerce also confirmed its preliminary finding that four companies -- Bien Dong Seafood Co., Ltd.; Vinh Hoan Corp.; Seavina Joint Stock Company; and BIM Foods Joint Stock Company -- had no shipments of subject merchandise during the period of review. Thus, the cash deposit rates currently in effect for these four companies will not change, and any entries during the period of review reported under their case numbers will be assessed duties at the 25.76% Vietnam-wide rate.

Commerce noted that though in its preliminary results it said it would rescind the review with respect to Vietnam Fish One, it determined after the preliminary results were published that Fish One must be included in the Vietnam-wide entity because of its historical "a.k.a. relationship" with Viet Hai Seafood Co., Ltd., a company Commerce determined belongs to the Vietnam-wide entity.

For any other exporters of subject merchandise that weren't under review (i.e., all exporters of subject merchandise except the companies listed above), cash deposit rates will remain at the level set in the most recent review of each respective company. For companies that have never been assigned a cash deposit rate by Commerce, the Vietnam-wide rate applies.
