ITC Issues Section 337 Import Ban on GPUs, Smart TVs

The International Trade Commission is issuing a limited exclusion order banning imports of imported graphics processing chips from TCL and Realtek that it found to be infringing on patents held by AMD, the ITC said in a notice Jan. 30 that brings the commission's Section 337 investigation to a close (ITC Inv. No. 337-TA-1318).

The ITC had begun the proceeding in June 2022 (see 2206060003), based on AMD's allegations of violations of five patents on multi-threaded graphics processing systems, unified shader systems, texture decompression, graphics thread synchronizers, and asynchronous processing for smart TVs by Realtek and TCL Industries Holdings Co. Ltd., along with 13 subsidiaries in China, Hong Kong, Mexico and Vietnam.

The limited exclusion order applies to TCL Industries Holdings Co., Ltd. and its subsidiaries TCL Industries Holdings (H.K.) Co. Limited; TCL Electronics Holdings Ltd. (f/k/a TCL Multimedia Technology Holdings, Ltd.); TCL Technology Group; TTE Corporation; TCL Holdings (BVI) Ltd.; TCL King Electrical Appliances (Huizhou) Co. Ltd.; Shenzhen TCL New Technology Co., Ltd.; TCL MOKA International Ltd.; TCL Smart Device (Vietnam) Co., Ltd.; Manufacturas Avanzadas SA de CV; TCL Electronics Mexico, S de RL de CV; TCL Overseas Marketing Ltd.; TTE Technology, Inc. It also covers infringing imports from Realtek Semiconductor Corporation.

The ITC also issued cease and desist orders against TCL and its affiliates, though it didn't issue a cease and desist order against Realtek.

The commission set bond at $0 for any covered product imported during the 60-day presidential review period.
