Door Threshold Maker Bows Out of EAPA Case After Stay Bid Denied

Defendant-intervenor Endura Products dropped out of an Enforce and Protect Act case at the Court of International Trade after its bid for a stay in the action pending the resolution of a scope proceeding also at the trade court was denied (see 2302060069). Submitting a motion to withdraw Feb. 21, Endura said it "no longer has an interest in the current appeal" (Columbia Aluminum Products v. United States, CIT # 19-00185).

The case stems from the EAPA investigation of Columbia Aluminum Products in which CBP found the company was evading the antidumping and countervailing duty orders on aluminum extrusions from China by transshipping the goods through Vietnam. Endura previously filed for a stay, asking the court to stop proceedings until it could appeal a separate CIT ruling in which the court upheld Commerce's decision to exclude Columbia's door thresholds from the scope of the AD/CVD orders (see 2212190051).
