Maxell Withdraws One Section 337 ITC Complaint on Smart Phones to Avoid 'Overlapping Demands'
The International Trade Commission has terminated an investigation on imported smart phones (ITC Inv. No. 337-TA-1312), according to a notice in the Federal Register.

That investigation began in May following a complaint by Maxell that alleged Lenovo and Motorola improperly imported smartphones infringing on six of Maxell's patents (see 2205030039). In its contingent motion for withdrawal, Maxell said that the overlapping issues meant that termination of the 1312 investigation would ensure that the parties "will not be subject to overlapping demands or conflicting decisions on two concurrently running investigations.” On July 18 Maxell filed a motion to terminate the investigation and withdrew its complaint, contingent upon the ITC instituting an investigation based on a separate case (ITC Docket No. 3625). That second investigation (ITC Inv. No. 337-TA-1324) formally began in August (see 2208190009).
