Census Issues Guidance for New License Exception ACE in AES

The Census Bureau will make several changes to the Automated Export System to accommodate the Commerce Department’s new Authorized Cybersecurity Exports (ACE) license exception, Census said in a Jan. 7 email. Among the changes, the agency will add new Export Control Classification Numbers 4A005 and 4D004 and will create new License Code C64 for the ACE exception.

Census said filers in AES must use License Code C64 when using the new license exception, or they will likely receive a fatal error. The available ECCNs for License Code C64 are 4A005, 4D001, 4D004, 4E001, 5A001, 5B001, 5D001 and 5E001.

New License Exception ACE, announced by the Bureau of Industry and Security in October along with new export controls for certain cybersecurity items, will take effect Jan. 19 (see 2110200036). The exception will allow exports of certain cybersecurity items to most destinations, except to destinations listed in Country Groups E:1 and E:2 and certain end-users.
