Thailand Circular Welded Pipe: Dual-Stenciled Pipe Preliminarily Subject to AD Duties

Commerce Department has preliminarily found that dual-stenciled standard and line pipe is covered by the antidumping duty order on circular welded carbon steel pipes and tubes from Thailand (A-549-502), it said in a recent preliminary scope ruling. While AD duty orders on similar goods from other countries, including Mexico and Venezuela, exempt all line pipe, including dual-stenciled, there is no exemption under the Thai AD duty order on circular welded pipe, Commerce said.

The pipe at issue in the scope inquiry, self-initiated by Commerce, is line pipe with outside diameters of 0.375 to 16 inches. Line pipe is meant for pipeline systems, and is produced to stricter specifications than for standard pipe, using better quality steel. Line pipe was withdrawn from the original petition for AD duties on circular welded pipe from Thailand, and was not included in the International Trade Commission’s injury determination, so it is not subject to the resulting AD duty order.

However, some of the pipe covered by the scope ruling, as imported by Saha Thai, is stenciled to indicate compliance with specifications for both standard and line pipe. This “dual stenciled” pipe is not exempt from the AD duty order on circular welded pipe from Thailand, and as standard pipe is covered by AD duties, Commerce said. While dual-stenciled pipe is classified as line pipe in the tariff schedule, “CBP’s classification rules are not binding with respect to Commerce’s analysis of whether dual-stenciled pipe is covered by the Order,” Commerce said.
