ACE Deadline for APHIS 'Core' in Early Fall, NMFS in Next Few Weeks, CBP Says in PGA Update

CBP plans to mandate filing in ACE of electronic Animal and Plant Health Inspection Service “core” data “early this fall,” it said in an update on the status of partner government agency (PGA) pilots (here). The pilot for APHIS core, which includes all filings except those required by the Lacey Act, such as PGA data required for imports of plants, live animals and animal products under APHIS’ Animal Care, Biotechnology Regulatory Services, Veterinary Services and Plant Protection and Quarantine programs, is set to end Aug. 15, at which point "entry filers will be required to file electronic entries in ACE with APHIS data and some or all APHIS forms using the method designated on the CBP Web site for the submission of the APHIS data and forms" (see 1607150020). Also on the horizon is the ACE mandatory use date for National Marine Fisheries Service data, coming in “late August or September,” CBP said.

Joining APHIS core and NMFS as “near term programming” in ACE are the Alcohol and Tobacco Tax and Trade Bureau, which will provide its mandatory use date when it finalizes regulatory changes it proposed in June (see 1606200029), the Food Safety Inspection Service, and the Department of Defense Trade Controls. The Bureau of Alcohol, Tobacco, Firearms and Explosives, also “near term,” expects to end its pilot in a notice published in late August, CBP said.

Following programming for the “Group A” near term PGAs, CBP plans to prioritize a second set of agencies with ongoing pilots. That includes the Drug Enforcement Administration, which began its pilot Aug. 1, and the Fish and Wildlife Service, which began a pilot July 27, as well as the Agricultural Marketing Service and Consumer Product Safety Commission. “Group B” also includes the Environmental Protection Agency, which will continue its several ongoing pilots until it publishes a final rule, and the State Department’s Office of Marine Conservation, which will begin its pilot soon.

Also in the update, CBP said it plans to make filing of APHIS Lacey Act data for type 06 entries and entry summaries mandatory on Nov. 28. Industry has expressed some confusion over general Lacey Act requirements for FTZ entries (see 1602180035). CBP has said APHIS Lacey Act data for type 06 entries and entry summaries was mandatory in ACE on May 28 (see 1602080042), and the agency continues to list May 28 as the mandatory use date for type 06 Lacey Act entries on its website (here). CBP did not comment.
