Nov. 11 CBP Bulletin Proposes to Revoke Rulings on Snowman Bags, Glass Balls
In the Nov. 11 issue of the CBP Customs Bulletin (Vol. 49, No. 44) (here), CBP published notices that propose to revoke or modify rulings and similar treatment for snowman gift bags and glass balls.

Comments on Proposals Due Dec. 11
CBP said consideration will be given to any written comments received by Dec. 11 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions, or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)
Proposals
CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.
Snowman Gift Bag
Item: Novelty gift bags that consisting of a paper bag sandwiched between two die-cut paperboard pieces in the shape of a snowman head and face. The top hat of the snowman has sections die-cut from the paperboard to form handles. |

Reason: The bag should not be classified as a folding box under subheading 4819.20 because the characteristic of the gift bag that provides its shape and form is the paper bag, and no assembly is needed in order to form the paper bag, said CBP. |

Proposed: 7020.00.60, 5%, (Other articles of glass: Other.) |
Reason: Laboratory glassware in heading 7017 is used for furthering scientific processes within a laboratory setting, while the glass balls at issue are used within a medical device that is designed for the intravenous administration of drugs to patients. Heading 7020 best describes the merchandise as an article of glass, as it is not properly classifiable under some other heading, said CBP. |
