CBP LA Updates Procedures for Goods Refused by FDA

CBP and the Food and Drug Administration created a joint Federal Destruction and Redelivery Team (Team FDR) to handle shipments refused by the FDA, said the CBP Los Angeles Field Office in a public bulletin. The field office is updating the process for exporting and destroying such shipments based on the new Team FDR, effective immediately, it said.

Importers of goods refused by the FDA will now get a "Refusal Redelivery Notice," rather than the Form 4647 and Notice of FDA Action, said CBP. The new RRN will be stamped by CBP to indicate redelivery of the goods, which must be exported or destroyed under CBP and FDA supervision within 90 days of refusal. The importer is responsible to recall the goods if the product has been distributed, said CBP.

Any shipments filed for entry with CBP through L.A. International Airport and L.A./Long Beach Seaports that are refused by FDA will be redelivered to the L.A. FDA examination Area. To export the refused goods, the importer must file a Form 7512 either with the Dock Exam Desk or through the Automated Commercial Environment, said CBP. The importer must also provide the RRN and other documentation, said the agency. To destroy the refused goods, the importer must file a Form 3499 and the other documentation and schedule an appointment with a FDA witness for the destruction. After destruction, the FDA inspector will return a signed Form 3499 to the Dock Exam Desk, which will then give a copy to broker or importer, said CBP.
