Italy Pasta: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on pasta from Italy (A-475-818). The agency calculated a preliminary AD rate of zero percent for the Rummo Group, preliminarily found dumping by the other mandatory respondent, Tomasello, and preliminarily assigned six non-individually investigated companies an average rate.

Rates Only Preliminary; Cash Deposit Rates From Previous Proceedings Still in Effect

These preliminary results are not in effect, and do not affect cash deposit requirements currently in place. Commerce may still change its calculations when it issues the final results of this administrative review. For now, the most recent final AD rate calculated for each Italian company is still applicable. If no final AD duty rate has ever been calculated for a company, then it is subject to the "all others" rate of 15.45%. The final results of this administrative review are currently due in December.

Cash Deposit Requirements

Any changes to AD duty cash deposit requirements will take effect on the date of publication of the final results in the Federal Register. Because Tomasello was preliminarily assigned a zero AD duty rate, if its rate is confirmed in the final results it will not be subject to AD duty cash deposit requirements until further notice. Commerce preliminarily calculated the following AD duty cash deposit rates:

Assessment Rates

As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between July 1, 2012 and June 30, 2013. If these preliminary results are confirmed in the final results, importers of subject merchandise exported by Tomasello and entered during the period under review will not be assessed AD duties.
